The Capital Network Privacy Policy

This Privacy Policy (“Policy”) sets forth The Capital Network, Inc. (“The Capital Network”, “TCN”, “we”, “our”, “us”, etc.) policies regarding the collection and use of personal information relating to the The Capital Network web site located at www.thecapitalnetwork.org, including the blog and registration database available through such website (collectively, “Site”). By accessing the Site on any computer, mobile phone, tablet, or other device, registering for events, forums, programs or courses or as a member of The Capital Network, or otherwise interacting with The Capital Network, you agree to the terms of this Policy. If you do not agree to this policy, please do not use the Site.

Information We Collect

Personally Identifiable Information

“Personal Information” is your personally identifiable contact information or other information that can be used to identify you, such as your name, e-mail address, telephone number or similar information. The Capital Network only collects Personal Information that you choose to share with us, such as when (1) contacting us via the Site (by clicking on the “Contact Us” link at the top of each web page); (2) registering online for an events, forums, programs or courses; (3) registering as a member of The Capital Network, whether as an investor or entrepreneur; (4) joining our e-mail mailing list through a sign-up box on the site.

Registered Members

In order to become a registered member of The Capital Network you must provide us with certain Personal Information, including your name, company name, designation, e-mail address, postal mail address, phone number, and fax number, along with payment information, which may include credit card information. We will use this Personal Information to review and verify your registration information. We, directly or through our Service Providers, may use your Personal Information to send periodic marketing or promotional notices, including notices about investor forums and upcoming meetings, or to notify you of any changes to this Policy. You can always opt-out of receiving these communications (except for communications necessary for your use of the Site) from us by following the procedures described in the “Opt-out Choices” section below. We, directly or through our Service Providers, may also use your Personal Information to improve our marketing efforts, statistically evaluate Site usage, improve our Site or customize our Site’s content, layout and services.

Usage Data

The Site automatically tracks certain information about your behavior while visiting the Site (“Usage Data”). We do not track the URL from which you arrive at the Site, and only track the next-visited URL if it is from a link specifically provided on the Site. We collect and store this aggregate information in order to measure the Site’s performance and improve the Site’s design and functionality. We may also share this aggregate information with third parties to illustrate how the Site is used and for other marketing purposes. If you are a registered member, we may use your Usage Data with or without your Personal Information, in order to measure the Site’s performance and improve the Site’s design and functionality.

Cookies

Like many websites, we analyze how visitors use our Sites through what is known as "cookie" technology or similar tracking tools. A cookie is a piece of data stored on the user’s hard drive containing information about the user. We may use cookies to: (1) allow you to use the Site without having to re-enter your user name and password; (2) enhance or personalize your Site usage and experience; (3) monitor Site usage; (4) manage the Site; and (5) improve the Site and our products and services, although usage of a cookie is in no way linked to any Personal Information while on the Site. Cookies benefit our members by automating some log in procedures and helping personalize the Site automatically, without requiring your password. All secure and confidential information will require you to log in using your password. If you choose, you can set your browser to reject cookies or you can manually delete individual cookies or all of the cookies on your computer by following your browser’s help file directions. However, if your browser is set to reject cookies or you manually delete cookies, you may have some trouble accessing and using some of the pages and features that are currently on the Site, or that we may put on the Site in the future. Note that browser-management tools for cookies are outside of our control and we cannot guarantee their effectiveness. 

Children

Our Site is not generally intended for use by children under the age of 13, and The Capital Network does not knowingly collect Personal Information from children in this age group. If we become aware that a user under the age of 13 has registered as a member or is attempting to register as a member, we will notify the user that he or she is not eligible for registration. We will then make reasonable efforts to expunge any related Personal Information from our records. If a child has provided us with Personal Information, a parent or guardian of that child may send an e-mail to the address found on the Contact Us page of the Site, or call the telephone number found on the Contact Us page of the Site with “Request for Child Information Removal” on the subject line and the name and age of the child in the body of the message. After confirmation, we will make reasonable efforts to expunge the child’s information from the database that stores information for the Site.

Use of Your Personal Information

Representation Regarding Accuracy

Any information you provide to TCN must be true, accurate, current, non-misleading, and consistent and relevant for the purpose for which you are providing the information. If you are a registered member, you must have the authority to provide the information submitted to and through the Site.

Disclosure of Information

The Capital Network makes reasonable efforts to preserve user privacy. However, we reserve the right to disclose Personal Information when required or permitted by law and we have a good faith belief that such action is necessary to comply with an appropriate law enforcement investigation, current judicial proceeding, a court order or legal process served on us, to enforce this Policy or other Site rules and policies, or to respond to claims that you are involved in activities that violate the rights of third parties.

Without limiting the foregoing, we may disclose your information, including Personal Information, in accordance with the following:

  • Affiliated Businesses We Do Not Control: We work closely with our affiliated businesses. When an affiliated business is involved in your transactions, we share your information, including Personal Information, related to those transactions with that business.

  • Agents and Contractors: We contract with other companies and individuals to operate the Site and to perform functions on our behalf (such companies and individuals “Service Providers”). Examples include maintaining and hosting the Site, delivering packages, sending postal mail and email, removing repetitive information from customer lists, analyzing data, providing marketing assistance, processing credit card payments, and providing customer service. Our Service Providers have access to your information, including Personal Information, needed to perform their functions, but they may not use it or disclose it for other purposes.

  • Business Transfers: In the event that we merge or consolidate our company with another party, or otherwise transfer any assets of our company, we may provide your information, including Personal Information, to the applicable transaction party so that you may continue the relationship or business with the resulting entity.

  • Consent: We may also disclose your Personal Information with your express consent. 

Access, Correction, & Deletion

We respect your right to access and correct your Personal Information. If you are a registered member, you may access your account information by signing into your account. From there, you can correct or modify your information. You may also exercise your rights, subject to applicable laws, to request that we delete or restrict access to your Personal Information. We may need to retain it for legally permitted purposes and this will be explained to you if necessary.

Retention of Personal Information

Personal information that we collect, access or process will be retained only as long as necessary for the fulfillment of the purposes for which it was collected, unless otherwise provided in agreements between you and The Capital Network or as required or authorized by law. Personal information that is no longer required to fulfill the identified purposes will be destroyed, erased or made de-identified.

Consent to Processing and Cross-Border Transfer

It is important to note that the Site is hosted and operated in the United States. If you are visiting the Sites from outside the United States, your information may be transferred to, stored and processed in the United States or other countries in accordance with this Policy.  By using our Site, or providing information to The Capital Network, you understand and unambiguously consent to the collection, processing, transfer, disclosure and use of the information in the United States and other countries and territories, for the purposes set forth in this Policy. You hereby consent to the collection, processing, transferring and disclosure by The Capital Network of your Personal Information between The Capital Network’s Service Providers and affiliates in accordance with this Policy. For further certainty, any consent relating to a right to transfer information referred to in this paragraph shall be deemed to include your consent to the transfer of applicable Personal Information to the United States. The data protection and other applicable laws of the United States or other countries may not be as comprehensive as those laws or regulations in your country or may otherwise differ from the data protection or consumer protection laws in your country. Your information may be available to government authorities under lawful orders and law applicable in such jurisdictions. 

Your California Privacy Rights

California law permits our customers who are California residents to request certain information about our disclosure of Personal Information to third parties for their own direct marketing purposes during the preceding calendar year. This request is free and may be made once a year. To make such a request, please write to us at the address included in the “Contacting us” section below with “ATTN: California Privacy Info.” In the subject line.

If you are a resident of California, the California Consumer Privacy Act (“CCPA”) provides you with other rights.  The CCPA currently does not apply to the Site as The Capital Network is a non-profit (501c3) organization, but feel free to reach out to us if you have questions using the contact information detailed in the “Contacting us” section below. 

Opt-out Choices

To “opt-out” of (1) receiving communications from The Capital Network (except for communications necessary for your use of the Site), (2) having your Personal Information disclosed to third parties for marketing purposes, or (3) any other consent previously granted for a specific purpose concerning your Personal Information, send an e-mail to the address found on the Contact Us page of the Site, or call the telephone number found on the Contact Us page of the Site. We will comply with a valid request for removal within 48 hours of receipt of the e-mail or phone call.

Third Party Web Sites

This Policy applies only to sites maintained by TCN. This Site contains links to other web sites. Please be aware that we are not responsible for the privacy practices of such other web sites. We encourage our users to be aware when they leave our Site and to read the privacy statements of each and every web site that collects personally identifiable information.

Security

We intend to protect your Personal Information and to maintain its quality. We implement reasonable and appropriate security measures and processes. The Site is hosted in a dedicated server in a co-location facility, and we have taken certain physical, electronic, and administrative steps to safeguard and secure the information we collect from visitors to the Site. The server resides in a secured area, with active Intrusion Detection System (IDS) monitoring, managed firewall services and a backup data system.

Although we follow reasonable procedures designed to protect the information in our possession, no security system is completely secure and we cannot guarantee, and you should not expect, that your Personal Information or private communications will remain private and secure under all circumstances.

WE DISCLAIM ANY AND ALL LIABILITY FOR ANY INFORMATION YOU SUBMIT TO OR RECEIVE FROM TCN. WE ALSO DO NOT ASSUME ANY RESPONSIBILITY OR LIABILITY FOR YOUR OWN OR A THIRD PARTY’S USE OR MISUSE OF INFORMATION TRANSMITTED OR RECEIVED DURING USE OF THE SITE.

Changes to This Policy

TCN may, in its sole discretion, update this Policy at any time and from time to time, by posting the amended Policy on this Site. The amended Policy shall be effective upon posting, and your access to or use of the Site following an update shall be deemed consent to the revised Policy. If you are a registered member, notice of amendments to this Policy may be sent to you via e-mail or such other form of communications as you have requested. We urge each visitor to refer back to this page regularly and especially prior to providing or updating any Personal Information. This Policy may not be otherwise amended without the written consent of TCN.
